Terms of Use Policy

Welcome to Festive Farmettes.
These Terms of Use apply to the Festive Farmettes website, including Captain’s Charitable Treasure Trove (“Trove”), Captain’s Originals and related content, products, memberships, events and offerings (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Acceptance of Terms
Your use of the Site constitutes agreement to these Terms and to any policies or terms specifically referenced in connection with an offering.
2. Nature of FFLT and Site Offerings
Festive Farmettes Land Trust is a perpetual charitable land trust focused on preserving land, supporting food systems and serving communities.
FFLT is not a nonprofit corporation and is not a 501(c)(3) organization.
Trove offers mission-aligned retail products and related experiences.
Products and other offerings may be limited, seasonal, made-to-order or available only while supplies or capacity permit.
Payments for products, memberships, events or other offerings are not tax-deductible charitable contributions.
3. Use of the Site
You agree to use the Site lawfully and not to:

Interfere with or disrupt Site functionality

Attempt unauthorized access to the Site, accounts, systems or data

Misrepresent your identity or intent

Use the Site for unlawful, fraudulent or abusive purposes

Violate applicable laws or the rights of others
We may restrict or terminate access to the Site when reasonably necessary to protect the Site, its users, our rights or the rights of others.
4. Purchases
Purchases made through Trove may be fulfilled by third-party production, payment, shipping or fulfillment providers.
You acknowledge that:

Minor variations in color, placement, texture, dimensions or appearance may occur

Product images may appear differently depending on screens, displays or production methods

Availability may change without notice
All sales are final except as provided in our Return & Refund Policy or as otherwise required by applicable law.
5. Returns, Refunds and Product Issues
Returns, refunds, replacements and product issues are governed by our Return & Refund Policy.
Under our voluntary policy:

Eligible issues must be reported within 7 days of confirmed delivery

Refunds or replacements are limited to verified defects, damage, incorrect items or fulfillment errors
Nothing in our Return & Refund Policy limits any right or remedy that cannot lawfully be limited or waived.
6. Shipping and Delivery
Shipping and delivery dates are estimates.
Production and delivery times may be affected by third-party fulfillment providers, carriers, weather, supply availability and other circumstances.
If an order cannot be shipped or delivered within the time required by applicable law, it will be handled in accordance with applicable law, including any required notice, consent, cancellation or refund.
7. Intellectual Property and Artwork Protection
All Site content, including artwork, designs, logos, text, photographs, graphics, product imagery and other creative material, is protected by copyright, trademark and other intellectual property laws.
Such content is owned by FFLT, Trove, Captain’s Originals and/or the applicable creator or rights holder.
Except for the limited right to access and view the Site, and except as otherwise expressly authorized or permitted by law, no intellectual property rights are granted or transferred.
Artwork displayed on the Site may include visible or embedded watermarks, identifying elements or other protective features. These protections may be removed from authorized purchased products where appropriate.
You may not, without authorization:

Reproduce, republish or commercially exploit Site content

Download or store artwork or product imagery for unauthorized use

Modify, distribute, sell, license or create unauthorized derivative works

Remove, obscure or bypass watermarks or identifying features

Use artwork, designs or other protected content on products, advertising, websites, social media, artificial intelligence systems, datasets or other media without permission
Purchase of a physical product transfers ownership of that physical item only. It does not transfer copyright, reproduction, licensing, distribution or derivative-work rights in the artwork or design.
Permitted use includes viewing Site content and using lawfully purchased products for personal enjoyment, subject to applicable law.
Unauthorized use may result in enforcement of applicable legal rights and remedies.
8. Memberships, Clubs, Subscriptions and Events
Participation in memberships, clubs, events or other experiences may require registration, payment, RSVP or acceptance of additional terms.
Availability, schedules, features and participation requirements may change.
For any recurring membership, club or subscription, the price, billing frequency, renewal terms and cancellation terms presented at enrollment are part of your agreement.
By enrolling in a recurring offering, you authorize the applicable recurring charges until cancellation.
Cancellation methods will be provided at enrollment or through the applicable account or service. Required renewal, price-change and cancellation notices will be provided as required by applicable law.
We may modify or discontinue offerings, subject to any obligations that apply to existing paid participants.
9. Land Programs
Information regarding land, property, stewardship, preservation, farming, leasing, trusts or related opportunities is provided for general informational purposes only.
Nothing on the Site constitutes legal, tax, investment, real estate or financial advice.
Separate written agreements may apply to any land-related transaction, relationship or program.
10. Third-Party Providers and Links
We may use third-party providers for payment processing, production, fulfillment, shipping, technology and related services.
Third-party services may be governed by their own terms and privacy practices.
To the fullest extent permitted by law, we are not responsible for delays, outages or failures caused solely by third parties or circumstances outside our reasonable control.
Nothing in this section limits rights that applicable law provides to you in connection with a purchase or service obtained from us.
11. Disclaimers and Limitation of Liability
Site content is provided on an “as available” basis.
To the fullest extent permitted by law, we do not guarantee that the Site will always be uninterrupted, error-free or available.
Nothing in these Terms disclaims or limits warranties, consumer protections or other rights that cannot lawfully be disclaimed or limited.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from use of the Site.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
12. Privacy
Use of personal information collected through the Site is governed by our Privacy Policy and applicable law.
Third-party payment, fulfillment or technology providers may separately process information under their own privacy policies.
13. Changes to These Terms
We may update these Terms from time to time.
Updated Terms will be posted with a revised “Last Updated” date.
Where required by law, we will provide notice of material changes before they take effect.
Changes affecting recurring memberships, subscriptions or continuous-service arrangements will be handled in accordance with applicable law.
14. Governing Law
These Terms are governed by the laws of the State of California, except to the extent applicable law requires otherwise.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
